Strict liability is the newest legal method for consumer protection in different legal systems. Strict liability means that producer of a defective product is liable for damage caused by a defect in his product irrespective of his negligence or not .This method was created because of deficiency of contractual responsibility and tort on negligence systems. While this method has been provided in laws of different countries such as Swiss, in Iranian legislator and jurisprudence, there are not efficient and suitable regulations in order to protect consumers well.
In this article, we compare the product liability in Swiss Law and Iranian Law and then, we discuss on the deficiencies of our legal system. Also we consider the approval of Iranian Parliament on Consumer Protection.
